1. General information only
Content on our website, app and marketing material is general information about the Platform. We take reasonable care to keep it accurate but make no representation as to completeness, currency or suitability for your circumstances. Features, practitioners and pricing change.
2. We are a platform, not a doctor
Caresoft does not practise medicine. Practitioners on Nirvaan are independent professionals — not our employees, not our agents, not supervised by us clinically.
We do not choose, review, approve, verify or overrule any clinical advice given on this Platform. The consultation is between you and the practitioner.
A claim about clinical care lies against the practitioner, and may be pursued through their medical council or a consumer forum. We will provide the consultation record and our verification records to support any such proceeding.
3. No clinical warranty
We give no warranty that any advice given on the Platform is correct, complete, appropriate for you, or consistent with what another practitioner would say. We do not warrant that any condition will be diagnosed, improve, or be resolved.
Medicine involves judgement, and reasonable practitioners differ. If advice does not seem right to you, seek a second opinion — that is a normal and sensible thing to do.
4. Verification is not endorsement
We verify identity, registration and qualifications, and check that registration has not been suspended or cancelled. That is all a verified badge means.
We do not verify clinical competence, quality of care, communication skill, or outcomes for any patient. A registered practitioner is one who is legally entitled to practise — not one we vouch for.
5. Remote consultation has real limits
A practitioner working remotely cannot examine you, cannot order or see tests directly, and is working entirely from what you tell them. Some conditions in this category cannot be safely assessed without examination.
- A practitioner who says you need in-person care is telling you something important. Act on it.
- Incomplete or inaccurate history leads to wrong advice, and the practitioner has no way to know what you left out.
- Never delay urgent care because you are waiting for or relying on a consultation here.
6. No entitlement to a prescription
Paying for a consultation buys a practitioner's time and professional opinion. It does not buy a prescription, a diagnosis, or a particular answer.
- Remote prescribing is restricted by the Telemedicine Practice Guidelines, 2020, and some medicines can never be prescribed this way. The Platform enforces those lists.
- Narcotic and psychotropic substances are never prescribed here.
- A practitioner may decline to prescribe anything at all. A practitioner who declines is doing their job properly.
- Counsellors and therapists who are not Registered Medical Practitioners cannot prescribe.
7. Content is information, not advice
Articles, guides and educational material are general information about health topics. They are not medical advice, take no account of your circumstances, and are not a substitute for consulting a practitioner about you specifically.
Where content shows a named medical reviewer and date, that reviewer checked it for accuracy at that time. Content without a named reviewer is general information only. Medical understanding changes, and content may not reflect the most recent evidence.
8. Advertising law and why we say so little
You may notice that Nirvaan never promises results, never claims to cure anything, and describes conditions carefully. That is deliberate and it is legally required.
The Drugs and Magic Remedies (Objectionable Advertisements) Act, 1954 is a criminal statute that prohibits advertising remedies for a list of conditions — and sexual impotence is on that list. Any platform in this category making cure claims is breaking that law.
- Nothing on Nirvaan claims to cure, guarantee, enhance, enlarge or permanently resolve anything.
- Our Content & Advertising Policy enforces this on articles, practitioner profiles, store listings and reviews.
- If you see a competitor promising a guaranteed cure, that is a reason to distrust them, not a reason we are less capable.
9. Self-assessment tools
Tools are educational aids, not diagnostic instruments. A result is not a diagnosis, does not confirm or exclude any condition, and must never be used to decide against seeking care.
A reassuring result excludes nothing. If you are worried, that is reason enough to speak to someone.
Tools do not account for your history, medications, other conditions or circumstances, and are not validated diagnostic instruments.
10. Ratings and reviews
Reviews reflect individual experience at a particular time. They are moderated for abuse, personal data and content breaching the Content Policy, but we do not verify their clinical accuracy and they are not a measure of clinical quality.
A high rating may reflect manner rather than medicine. A practitioner who declined to prescribe may be rated poorly for exactly the reason you should trust them.
11. Store products
- Caresoft is not a pharmacy and does not dispense medicine. Fulfilment arrangements are stated at checkout.
- Prescription products are gated on a valid prescription issued through the Platform.
- Non-prescription products carry no therapeutic claim. Nothing in the store treats a condition on its own, and buying a product is not a substitute for consulting a practitioner.
- Product information comes from manufacturers. Read the label and package insert, which prevail over any description on our site.
12. Unlicensed products
Sexual health is among the most counterfeited product categories in India. Unlicensed "capsules", "oils" and "kits" sold online, in newspapers and by unregistered practitioners frequently contain undeclared prescription drugs, heavy metals or steroids, and have caused serious harm.
Take prescriptions to a licensed pharmacy. Tell your practitioner about anything you have already taken, including anything bought without a prescription — especially if you would rather not admit to it.
13. No continuity of care
Nirvaan is episodic. There is no guarantee the same practitioner will be available again, no ongoing responsibility between consultations, and nobody monitoring your condition.
No practitioner here is "your doctor" in a continuing sense. For anything ongoing or serious, be under the care of someone who knows you, in person.
14. Anonymity has limits and costs
- Legal limits. Anonymity does not override the law — see Privacy Policy §5, particularly mandatory reporting under the POCSO Act, 2012.
- Practical limits. We cannot hide your use of the Platform from someone with access to your phone, messages or payment statement. See Privacy Policy §20.
- Clinical cost. A practitioner without your identity, records or history is working with less information than a doctor who knows you. That is a real trade-off you are making, and it is worth being conscious of it.
15. Availability
The Platform is provided on an "as available" basis, without uptime commitment. Practitioner availability varies and is not guaranteed. Chat, voice and video depend on your connection and on third-party providers. Never rely on the Platform being available when you need it.
16. Device and environment
We are not responsible for your device, your connection, or who else can see your screen or hear your call. Have consultations somewhere private. Consider notification previews, shared devices and shared payment methods.
17. Security representations
We maintain the measures in the Privacy Policy §17, but no system is completely secure and we do not warrant freedom from vulnerabilities or unauthorised access. We cannot technically prevent another party recording their own screen, though doing so is prohibited.
18. No outcome claims
Any figures about improvement rates, satisfaction, resolution or time to results are illustrative and depend on the individual, the condition and adherence to advice. They are not promises and are not relied upon by either party.
19. Third parties and links
Links to third-party sites, including crisis and support services, are provided for convenience. We do not control them and are not responsible for their content or availability — though we check crisis resources regularly, and would want to know immediately if one is wrong. Third-party names and marks belong to their owners.
20. Disclaimer of warranties
THE PLATFORM, CONTENT, TOOLS AND STORE ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTY OF ANY KIND, EXPRESS, IMPLIED OR STATUTORY.
WE GIVE NO CLINICAL WARRANTY OF ANY KIND. WE DO NOT WARRANT THAT ANY ADVICE IS CORRECT OR SUITABLE; THAT ANY PRACTITIONER IS COMPETENT BEYOND BEING REGISTERED; THAT ANY CONDITION WILL IMPROVE; THAT A PRACTITIONER WILL BE AVAILABLE; THAT YOU WILL RECEIVE A PRESCRIPTION; THAT ANY TOOL RESULT IS ACCURATE; OR THAT THE PLATFORM WILL BE UNINTERRUPTED OR ERROR-FREE.
21. Limitation of liability
OUR LIABILITY IS LIMITED AS SET OUT IN TERMS OF USE §22, INCLUDING THE EXCLUSION OF INDIRECT AND CONSEQUENTIAL LOSS.
IN PARTICULAR WE ARE NOT LIABLE FOR: THE CLINICAL ACTS OR OMISSIONS OF ANY PRACTITIONER; ADVICE GIVEN OR NOT GIVEN; A PRACTITIONER DECLINING TO PRESCRIBE OR TO CONSULT; ANY TOOL RESULT; ANY CONTENT READ AS ADVICE; ANY PRODUCT OBTAINED OUTSIDE THE PLATFORM; ANY CONSEQUENCE OF DELAYING IN-PERSON CARE; OR ANY ARRANGEMENT MADE WITH A PRACTITIONER OFF-PLATFORM.
Nothing here limits liability for fraud, death or personal injury caused by negligence, or any liability that cannot lawfully be limited — including your rights under the Consumer Protection Act, 2019.
22. Governing law and contact
Governed by the laws of India and subject to Terms of Use §25. Nothing here removes your right to approach a consumer forum or any other remedy available under law.
